Condition foreseen by the International Union for the Protection of New Varieties of Plants (UPOV) in its convention as well as by the European Union in its Regulation (EC) 2100/94 on Community plant variety rights in order to grant a breeder's right. A plant variety will be distinct as long as it is clearly distinguishable by reference to the expression of the characteristics that results from a particular genotype or combination of genotypes, from any other variety whose existence is part of the common knowledge at the time of the date of application.
