The use of an independent Expert to investigate the referred matters and to give his opinion which becomes binding on the parties. Not strictly an ADR process.
A procedure whereby a dispute, perhaps of a technical nature, is to be resolved by an expert, nominated or identifiable, whose decision is to be final and binding on the parties, and who need not follow the rules of arbitration or litigation. ADR Principles & Practice, Henry Brown & Arthur Marriott
is a process in which the parties to a dispute present arguments and evidence to a neutral third party, who is chosen on the basis of their specialist qualification or experience in the subject matter of the dispute (the expert) and who makes a determination. (NADRAC's Definitions Paper)
