In determining whether a workplace has a hostile environment factors include the frequency of the offending conduct, the severity of the conduct, whether the conduct is physical or verbal, whether the conduct unreasonably interferes with a workersâ€™ performance, and the affect of the conduct on its victims. It is important to realize that there is NO LAW that requires employers to be nice to their workers. Just because an employer is mean to everyone does not mean that there is a legal cause of action.

The theory of hostile work environment is often the foundation for a claim of sexual harassment, but can also refer to attitudes and behaviors in addition to sexually offensive conduct.
