of a registered design will be declared where: the purported "design" in the application does not fall within the definition of that term; the design is not new or lacks individual character; the design is dictated by its technical function; the design is contrary to public policy or accepted principles of morality; the design includes emblems which constitute an improper use of items listed in Article 6ter of the Paris Convention or are of particular public interest in the UK; the design is in conflict with an earlier application or registration, that has been made available to the public or is protected prior to application or registration by virtue of the provisions under the Designs Act; the registered proprietor is not the proprietor of the design; the registration involves the use of an earlier distinctive sign for which rights protect the use in the UK; the registration constitutes an unauthorised use of a copyright work.
