Exception to Rule. When a provision of the Washington Administrative Code (WAC) is not applied because it would result in undue hardship to a client or defeat the purpose of the rule in a particular case. An exception to rule cannot be made for a provision of LAW. (For example, an exception could be made for a rule in WAC as long as it would not violate Public Law, The Code of Federal Regulations, and The Revised Code of Washington.) Exceptions to rule are determined by the Secretary of DSHS or a designee. Exception to rule decisions are not subject to fair hearings. See Exception to Rule
