A proceeding available only under the Simplified Procedure. Summary trials are a hybrid proceeding: part Summary Judgment motion, part trial. Evidence in Chief at the trial is by way of affidavit, but cross-examination takes place in open court. Summary Trials are subject to strict time limitations designed to ensure that they remain speedy and cost effective. Summary Trials are appropriate in many smaller actions that raise issues that cannot adequately be dealt with solely by affidavit evidence.
